1. Definitions

  • "We", "us", "our" — VFHub Ltd, trading as Venture Fitness, registered in England and Wales, company number 16503076, registered office 220 Torquay Road, Paignton, Devon, England, TQ3 2HN.
  • "You", "your", "Member" — the individual who has signed up for membership, a trial, a class pass, or a day pass at either site.
  • "Site(s)" — the Venture Fitness gym premises in Torquay and/or Newton Abbot.
  • "Membership" — any of the paid membership types listed in Section 3.
  • "Agreement" — these Terms & Conditions together with your signup form/application, and (where applicable) your Direct Debit instruction.
  • "Direct Debit Provider" — London + Zurich Ltd, the payment processor used to collect recurring membership fees.

2. Eligibility & Joining

2.1 You must be 16 years or older to join without parental/guardian consent. Members aged 14–15 may join with a parent/guardian's written consent and under any age-specific access restrictions we set. Under-14s are not permitted to hold a membership.

2.2 By joining, you confirm that the information you provide (name, address, date of birth, payment details, emergency contact) is accurate and current, and you agree to notify us promptly of any changes.

2.3 You confirm that you are medically fit to participate in exercise. If you have any pre-existing medical condition, injury, or concern, you must consult a doctor before starting, and should tell our staff so we can make reasonable adjustments where possible. We are not medical professionals and do not provide medical advice.

2.4 Membership is personal to you and non-transferable. Sharing your access credentials, key fob, or door code with any other person is a breach of this Agreement and may result in suspension or termination without refund.

2.5 We reserve the right to refuse or terminate membership at our discretion, including where a prospective or existing member's conduct poses a risk to staff, other members, or the safe operation of the Sites.


3. Membership Types & Fees

3.1 Annual membership early exit: Annual membership fees are non-refundable in full or in part, including where a member chooses to leave before the 12-month period ends.

3.2 All memberships give access to both the Torquay and Newton Abbot sites, 24/7, on a single membership.

3.3 Membership includes unlimited use of scheduled classes at both sites. Non-members may attend a class for the £8 day-pass rate.

3.4 There is no joining fee and no fixed minimum contract term on standard membership (beyond the notice period in Section 6).

3.5 We reserve the right to review and change membership pricing. Existing Direct Debit members will be given no less than 30 days' written notice (email) before any price change takes effect, and may cancel under Section 6 if they do not accept the new price.


4. Payment Terms

4.1 Recurring membership fees are collected by Direct Debit on or around the same date each month, starting from your join date.

4.2 If a payment fails, we (or our Direct Debit Provider) will attempt to collect it again. Continued failed payments may result in suspension of access until the account is brought up to date, and may incur a reasonable administration charge for failed collections.

4.3 You are responsible for keeping your payment details up to date. Membership fees are not waived for non-attendance — your fee covers ongoing access, not usage.

4.4 Annual and one-off payments (day passes, session packs) are due in full at the time of purchase and are non-refundable except as set out in Section 6.4 (medical exceptions) or as required by law.


5. Freezing / Pausing Membership

5.1 Members may freeze their membership for medical, injury, travel, or other genuine reasons, for a maximum of 3 months in any 12-month period, at no charge.

5.2 Freeze requests should be made in-gym with staff where possible; otherwise by email to vfhubltd@gmail.com, stating the requested start date and duration.

5.3 No Direct Debit payments will be collected during an approved freeze period. Membership and any related benefits (referral scheme, class access) are paused for the same period.

5.4 Freezes must be requested in advance of the next scheduled payment date to take effect on that cycle; freezes cannot generally be applied retroactively to a payment already collected.


6. Cancellation Policy

6.1 Notice period. To cancel your membership, you must give us 30 days' written notice. Your cancellation takes effect, and your final Direct Debit payment falls, 30 days from the date we receive your cancellation request — not 30 days from your original join date or renewal date.

6.2 How to cancel. Cancellation requests must be submitted in writing to vfhubltd@gmail.com. Verbal requests made in-gym to staff, phone calls, or social media messages are not a valid form of cancellation and will not be actioned — staff at either site cannot process cancellations directly; every request must go through this email address so there is a clear, dated record.

6.3 What happens if notice isn't given correctly. If you do not notify us of your intention to cancel in the required manner (in writing, to the correct email address), your cancellation request will not be processed and is forfeited. Your membership — and Direct Debit collection — will continue as normal until a valid, written 30-day notice is received. This applies even if you have stopped attending the gym; non-attendance alone does not cancel a membership.

6.4 Exceptions. We may, at our discretion, waive or shorten the 30-day notice period in cases of serious injury or medical condition that prevents you from exercising, supported by medical evidence where requested. There is no relocation-based exception — the standard 30-day notice period applies regardless of a member moving away from the area.

Requests for an exception should be sent to vfhubltd@gmail.com along with supporting evidence, and will be considered on a case-by-case basis.

6.5 Confirmation. We will confirm receipt of a valid cancellation request by email, along with the effective end date and the date of your final payment, within 5 working days (typically faster where the request is submitted via the app). If you haven't received confirmation within that window, please follow up — an unconfirmed request should not be assumed to have been processed.

6.6 Fixed-term / annual memberships. The 30-day cancellation notice applies to rolling monthly memberships. Annual memberships paid upfront are subject to the terms in Section 3.1 rather than this notice period, except where an exception under 6.4 applies.

6.7 Effect of cancellation. Once your cancellation takes effect, your access to both Sites, all classes, and any member benefits (referral scheme, member pricing) will end. You will need to sign up again as a new member, and any new-member terms in force at that time will apply, if you wish to rejoin.


7. Facility Access & 24/7 Use

7.1 Access to each Site is via key fob / door entry code issued to you personally. Codes and fobs must not be shared, photographed and passed on, or otherwise transferred to non-members.

7.2 As Sites operate 24/7 and may be unstaffed outside core hours, you accept personal responsibility for your safety when training outside staffed hours, and agree to follow all posted safety and emergency procedures (including emergency exits, panic alarms/help points, and CCTV notices).

7.3 We reserve the right to restrict 24/7 access to members who complete an induction, or to particular membership tiers, at our discretion.

7.4 Lost or stolen fobs must be reported immediately to vfhubltd@gmail.com. A replacement fee of £2 applies.

7.5 We may temporarily close all or part of a Site for maintenance, refurbishment, cleaning, or events, with reasonable notice where practical. No refund is due for short, reasonable closures; extended closures affecting your ability to use the Site may be addressed at our discretion (e.g. freeze applied automatically).


8. Classes, Personal Training & the Meet & Greet / Trial Programme

8.1 Group classes are included free and unlimited for members at both sites; non-members may attend for the £8 day-pass rate. Class places may be capacity-limited and bookable via the ClubRight booking system. There is currently no no-show or late-cancellation charge for booked classes, though we ask members to cancel a booking they can't make so the space can be released to others.

8.2 The free Meet & Greet and any complimentary PT sessions offered as part of the sign-up journey are one-time introductory offers per person and are not repeatable once redeemed.

8.3 The 3-session trial is free and must be used within 7 days of your first visit, or once all 3 sessions have been used — whichever happens first. The trial ends at that point regardless of how many sessions remain unused.

8.4 Personal training sessions delivered by Venture Fitness trainers are priced and sold separately from membership, and are subject to each individual trainer's own pricing and terms.

8.5 VF Sculpt and any other named sub-programmes operate under these same Terms & Conditions as a Venture Fitness membership tier, save for any programme-specific pricing or class structure communicated separately.


9. Referral Scheme

9.1 The current referral scheme offers £5 credit per successful referral, with five referrals earning a free month of membership, as set out in current marketing materials.

9.2 A referral is "successful" when the referred person joins as a paying member. The referral credit/discount continues to apply for as long as the referred member keeps their membership active. We reserve the right to amend or withdraw the referral scheme at any time with reasonable notice to members.


10. Code of Conduct

10.1 Members must treat staff and other members with respect. We operate a zero-tolerance approach to abusive, threatening, discriminatory, or harassing behaviour, and to conduct that endangers the safety of others.

10.2 Appropriate gym attire and footwear must be worn at all times. Equipment must be wiped down after use and re-racked. Filming or photographing other members without their consent is not permitted.

10.3 Breach of the Code of Conduct may result in a warning, suspension, or immediate termination of membership without refund, at our discretion, depending on severity.


11. Health, Safety & Liability

11.1 You use the Sites, equipment, and attend classes entirely at your own risk. We maintain equipment and premises to a reasonable standard and carry out routine safety checks, but exercise carries an inherent risk of injury.

11.2 We are not liable for any injury, loss, or damage arising from your use of the Sites, except where caused by our negligence, and nothing in this Agreement limits liability for death or personal injury caused by our negligence, or for fraud, to the extent such liability cannot lawfully be excluded.

11.3 We are not responsible for loss, theft, or damage to personal property brought onto the Sites, except where caused by our negligence. Lockers are provided for members' use at their own risk; we do not supply padlocks, so members should bring their own.

11.4 You must inform staff immediately of any accident, injury, or equipment fault, and accidents will be logged in our accident book.


12. Data Protection & GDPR

12.1 We process your personal data (including name, contact details, date of birth, payment information, and — where you choose to share it — health/medical information relevant to your training) in accordance with UK GDPR and the Data Protection Act 2018.

12.2 What we collect and why: contact and membership details to administer your membership and Direct Debit; attendance data via access control/booking systems to manage capacity and safety; and, where relevant, marketing consent to send you offers, class updates, and referral scheme communications.

12.3 Legal basis: performance of this Agreement (membership administration, Direct Debit collection), legitimate interests (site safety and security, including CCTV), consent (marketing communications, photography/testimonials — see Section 13), and legal obligation (financial record-keeping).

12.4 Data sharing: We share data with third-party processors necessary to run the business, including our CRM/booking provider (ClubRight), our Direct Debit provider (London + Zurich Ltd), and, where you interact with our marketing, Meta and Google advertising platforms. We do not sell your personal data.

12.5 Retention: We retain membership and financial data for the duration of your membership and for 6 years afterwards for legal, accounting, and dispute-resolution purposes, unless you request earlier deletion under Section 12.6 and we are not required to retain it for a legal or regulatory reason.

12.6 Your rights: You have the right to access, correct, or request deletion of your personal data, to withdraw consent to marketing at any time, and to lodge a complaint with the Information Commissioner's Office (ICO). Requests can be made to vfhubltd@gmail.com.

12.7 CCTV: Both Sites operate CCTV for security and safety purposes. Footage is retained for 2 weeks and handled in accordance with this policy.


13. Photography, Video & Marketing Consent

13.1 We may take photographs or video at the Sites (e.g. classes, events, content shoots) for use in our marketing, including social media and the website. Where you are identifiable and have not given specific consent, please let a staff member know if you'd prefer not to be filmed/photographed, and we will take reasonable steps to accommodate this.

13.2 Member testimonials, before/after content, or on-camera contributions will only be used with your explicit, separate consent, which you may withdraw at any time by contacting vfhubltd@gmail.com.


14. Complaints

14.1 If you're unhappy with any aspect of your membership or experience at either Site, please raise it with site staff in the first instance, or email vfhubltd@gmail.com.

14.2 We aim to acknowledge and respond to complaints within 5 working days wherever possible.


15. Changes to These Terms

15.1 We may update these Terms & Conditions from time to time, for example to reflect changes in the law, our services, or pricing. Material changes affecting existing members will be communicated by email with reasonable notice, and continued use of your membership after that notice period constitutes acceptance.

15.2 The current version of these Terms & Conditions will always be available at venturefitness.co.uk/terms.


16. General

16.1 Governing law: This Agreement is governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute.

16.2 Severability: If any provision of this Agreement is found unenforceable, the remaining provisions continue in full force.

16.3 Entire agreement: These Terms & Conditions, together with your signup application and any Direct Debit instruction, form the entire agreement between you and VFHub Ltd regarding your membership.
